Franchise Agreements

The City of Goodyear is a Charter City. What does that mean, you ask?

A Charter for cities is similar to what the Constitution is for federal and state governments. Cities that have charters are adopting basic governing principles for their city. A charter allows the city to govern their citizens without relying on the Legislature or statutes to provide the rules, instead, relying on the Charter to provide that guidance. The Charter will define what type of government the city will have – in our case it is a Council – Manager form of government with seven members on the Council all elected at large who appoints a City Manager as the chief administrative officer of the city. The Charter also defines term limits and qualifications for Council, among other things. Cities that do not have a Charter rely on “General Law” or Arizona Revised Statutes to determine what and how things are done.

Any change to the Charter requires a vote of the people.

Question 1 - Amendments to Article I

Question 1 would amend the Charter of the City of Goodyear, Article I: Incorporation, Form of Government, Powers of City, Boundaries

To specify that the City Council has the power by simple majority vote to establish land use and development regulations, zoning ordinances, architectural design, and site plan regulations and standards, that are consistent with the adopted General Plan.

Question 2 - Amendments to Article II

Question 2 would amend the Charter of the City of Goodyear, Article II: The Council, Section 11 Salaries

To add Benefits to the title, and to amend the procedure and scope of recommendations of the Citizen's Compensation Committee to include both adjustments to salaries and benefits and provide that the City Council may only accept or reject that recommendation by simple majority vote.

Question 3 - Amendments to Article IV

Question 3 would amend the Charter of the City of Goodyear, Article IV: Administrative Departments, Officers and Employees

To transfer authority to create, consolidate, alter or abolish the various city departments from the City Council to the City Manager within the approved budget authority and employee counts as otherwise approved by the City Council.

Question 4 - Amendments to Article VI

Question 4 would amend the Charter of the City of Goodyear, Article VI: Finance and Taxation

To codify allowable categories of municipal transaction privilege tax categories and to further codify existing rules regarding the procedure for bond approval and issuance.

Question 5 - Proposed EPCOR Franchise

Question 5 proposes a Franchise Agreement with EPCOR Water Arizona, Inc.

Granting a Franchise to EPCOR Water Arizona, Inc., for the purpose of providing water distribution and wastewater collection services within the city for which the city will receive a franchise fee.

Question 6 - Proposed Liberty Utilities Franchise

Question 6 proposes a Franchise Agreement with Liberty Utilities (Litchfield Park Water and Sewer) Corp.

Granting a Franchise to Liberty Utilities (Litchfield Park Water and Sewer) Corp. for the purpose of providing water distribution and wastewater collection services within the city for which the city will receive a franchise fee.

Beginning April 23, 2025, drop off your ballot at Goodyear City Hall located at 1900 N Civic Square, Goodyear, AZ 85395 during regular business hours Monday through Friday, 8 a.m. to 5 p.m.
